The Portal is owned by Gibernau and its use is subject to the following terms of use. The User of the Portal expressly accepts the terms in force at any given time and acknowledges that the Portal is used, in all cases, under their sole and exclusive responsibility.<\/p>\n

In any case, Gibernau reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the general and\/or specific terms, where applicable.<\/p>\n

Terms of use of the Portal<\/h2>\n

The Portal provides the User with material containing information from its own and third-party sources for information purposes only. Gibernau endeavours to ensure that the content of the Portal is of the highest possible quality. However, the User should bear in mind that such material may not accurately reflect the most recent legislative or case-law position on the matters discussed. The User is also informed that this material may be modified, developed or updated without prior notice.<\/p>\n

The material contained in the Portal does not in any way constitute the provision of tax, legal or any other kind of advisory service. Access to this material is not intended to create, and does not imply, any relationship between Gibernau and the User. Therefore, the User should not act on the basis of the information contained in the Portal without first obtaining appropriate professional advice.<\/p>\n

Links contained in the Portal may direct the User to other websites and\/or web pages managed by third parties, over which Gibernau has no control. Consequently, Gibernau accepts no liability for the content or status of such websites and\/or web pages. Limitation of liability<\/h2>\n

The User uses the Portal at their own risk. Gibernau is not liable for any errors or omissions in its content or in other content accessible through it. Nor shall Gibernau be held liable for any damage arising from the use of the Portal, or for any action taken on the basis of the information provided therein.<\/p>\n

Gibernau does not guarantee the absence of viruses or other harmful elements that could cause damage or alterations to the User’s computer system, electronic documents or files. Consequently, Gibernau is not liable for any loss or damage that such elements may cause to the User or to third parties.<\/p>\n

Personal data protection<\/h2>\n

Gibernau processes the personal data provided by the User through the Portal in accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016, the General Data Protection Regulation (hereinafter, “GDPR”), and Spanish Organic Law 3\/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, “LOPDGDD”).<\/p>\n

The data controller is Gibernau Asesores, S.L., whose identification details are set out at the beginning of this legal notice. Detailed information on the purposes of the processing, its legal basis, retention periods and recipients of the data can be found in our Privacy Policy<\/a>.<\/p>\n

The User may exercise their rights of access, rectification, erasure, objection, restriction of processing and data portability, and may withdraw their consent at any time, by sending a request to gibernau@gibernau.es<\/a> or by post to Gibernau, Rambla de Catalunya, 47, 1st floor, 08007 Barcelona, Spain. If the User considers that the processing of their data does not comply with the applicable regulations, they also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) (www.aepd.es<\/a>).<\/p>\n

Intellectual and industrial property rights<\/h2>\n

All content of the Portal, as well as its structure, design and source code, are owned by Gibernau or by third parties who have authorised their use, and are protected by the applicable intellectual and industrial property legislation. Under no circumstances does access to the Portal grant the User any rights over such content, not even for mere reproduction for personal use.<\/p>\n
